On Thursday, the Russian government approved amendments to the Criminal Code that will once again allow criminal liability for drug use and eliminate the concept of an average single dose of consumption, the Vremya Novostei newspaper writes.

Justice Minister Yuri Chaika reported this information to journalists after the government meeting. According to Chaika, the amendments will soon be sent to the State Duma.

Let us recall that the current version of the Criminal Code came into force in May last year. In this document, its authors tried to develop criteria,


distinguishing from the legal point of view between drug addicts and drug dealers. For this purpose, the concept of “average single dose of consumption” was developed. A “large size” drug was considered to be more than 10 single doses, and a “particularly large size” was considered to be more than 50 doses.

At the same time, a person in whose possession law enforcement agencies found a prohibited psychotropic substance in a quantity of less than 10 single doses could not be held criminally liable for its storage or sale.

The main supporter of last year's amendments was the Ministry of Foreign Affairs. On the contrary, the Ministry of Internal Affairs and the State Drug Control Service sharply criticized such changes to the Criminal Code and have been seeking to tighten the legislation ever since.

Chaika named the difficulties in developing standards for each specific narcotic substance as the formal reason for abolishing the concept of the average single dose of consumption. According to him, such a standard "must simultaneously satisfy medical, social and legal criteria," but this has not been achieved.

With the abolition of the concept of an average single dose, the government will have to develop new criteria for determining large and especially large amounts of drugs within 30 days of the law's publication. Human rights activists believe that they will be significantly reduced and, in the worst case, will approach the standards of the Soviet era, when traces of drugs on the tip of a needle after an injection were enough to bring someone to criminal liability.
