LICENSING FOR HEMP GROWING IN RUSSIA is carried out by the Ministry of Agriculture of the Russian Federation. According to the Decree of the Government of the Russian Federation No. 423 of June 14, 2002 “On approval of the regulations on licensing activities for the cultivation of plants used for the production of narcotic and psychotropic substances”, permits for this type of activity are issued to legal entities capable of preventing the theft of crops and preventing the use of hemp for the manufacture of psychotropic products. A mandatory requirement is the presence in the legal entity of specialists who have professional training in working with narcotic plants.
To obtain a license, an application must be submitted to the Ministry of Agriculture. The application must mention the name, legal form and location of the legal entity and the type of activity that the legal entity intends to carry out. The following documents must be attached to the application:
1. Constituent documents of a legal entity (copies).
2. Certificate of state registration of a legal entity (copy).
3. Certificate of registration of the license applicant with the tax authority (copy).
4. Receipt for payment of the license fee.
5. Certificate of a specialist (diploma, certificate, certificate) confirming the compliance of the professional training of the head of a legal entity or the corresponding division of a legal entity for working with narcotic plants (copy).
6. A document confirming the availability of safety conditions (issued by the district department of the Ministry of Internal Affairs).
7. A certificate from a health care institution confirming that the employees of the legal entity do not have drug or alcohol DEPENDENCE, as well as the absence of persons among them who are recognized as unsuitable for activities associated with a source of increased danger.
8. Conclusion from the Internal Affairs Directorate on the absence of outstanding or unremoved convictions for drug-related crimes among employees.
Copies of documents attached to the application must be certified by a notary.
Within 60 days, the Ministry of Agriculture must make a decision on whether to grant or deny a license. Its validity period is 5 years; upon expiration of the term, the license can be extended at the request of the licensee.
Once licensed, the licensee can grow hemp within quotas set by the licensing authority. A scheduled check of the licensee’s compliance with licensing requirements and conditions is carried out no more than once every 2 years.
Until recently, applications could be submitted to regional Ministries of Agriculture. Today, licensing is carried out only by the federal ministry located in Moscow.
