Family of Yukos lawyer detained at airport for drug smuggling08.02.2005
Ekaterina Guryanova, the wife of Pavel Ivlev, a lawyer for Yukos Oil Company from the law firm ALM-Feldmans, and their children were detained at Sheremetyevo-2 airport while flying to New York. The reason for the detention was suspicion of drug smuggling, reports the press center of the former head of YUKOS, Mikhail Khodorkovsky. Pavel Ivlev himself is currently in New York, Ekaterina Guryanova has a green card (residence permit in the USA), their children - a 12-year-old son and a preschool-age daughter - are US citizens, the press center noted. Meanwhile, later E. Guryanova’s lawyer Gevorg Dangyan told RBC that his client was not officially detained. According to him, at Sheremetyevo-2 airport she was “transported to give explanations on far-fetched suspicions,” which is why E. Guryanova and her children were late for their flight. In addition, today Mikhail Khodorkovsky's defense demanded that a package of documents concerning a number of charges be excluded from the case materials. Thus, we are talking about charges of embezzlement of funds belonging to the Yukos Oil Company, tax evasion by an individual, document forgery, as well as a number of episodes concerning fraud and failure to comply with a court decision. During today's hearing in the Meshchansky Court of Moscow, the lawyer for the former head of the Yukos Oil Company, Genrikh Padva, told the court that there are no corresponding orders to initiate criminal cases in the case regarding a number of charges against M. Khodorkovsky and the head of the Menatep International Financial Organization, Platon Lebedev. Thus, in the lawyer's opinion, the investigation into these charges was conducted illegally, and the documents obtained in the case materials have no legal force and are subject to exclusion. The court promised to make a decision on this defense motion later. Let us recall that M. Khodorkovsky and the head of the MFO "MENATEP" P. Lebedev are involved in a case of illegal seizure of a 20-percent state-owned shareholding in OAO "Apatit". They are charged under seven articles of the Criminal Code: Article 159 of the Criminal Code of the Russian Federation "theft of someone else's property by deception, as part of an organized group, on a large scale"; Article 315 of the Criminal Code of the Russian Federation "malicious failure to comply with a court decision that has entered into legal force by representatives of a commercial organization"; Article 165 of the Criminal Code of the Russian Federation "causing property damage to owners by deception, in the absence of signs of theft, committed by an organized group, on a large scale; Article 199 of the Criminal Code of the Russian Federation "evasion of taxes from an organization on an especially large scale, by a group of persons by prior conspiracy, repeatedly"; Article 198 of the Criminal Code of the Russian Federation "evasion by an individual of paying taxes or insurance premiums to state extra-budgetary funds, committed on an especially large scale"; Article 327 of the Criminal Code of the Russian Federation "forgery of official documents, committed repeatedly"; Article 160 of the Criminal Code of the Russian Federation "appropriation or embezzlement of someone else's property by an organized group, on a large scale". rbc.ru
